Terms of Service

By accessing or using Silicon Savannah Talent ("SST", "the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform.

These Terms constitute a legally binding agreement between you and Silicon Savannah Talent. We may update these Terms from time to time, and your continued use of the Platform after such changes constitutes acceptance of the revised Terms.

Silicon Savannah Talent is an AI-powered recruitment and project delivery platform that connects African tech talent with employers and project opportunities. Our services include:

• AI-assisted resume creation and profile building
• Semantic matching between candidates and job opportunities
• Employer recruitment tools including AI-powered job posting and candidate discovery
• Dreams2Reality project management with milestone-based delivery
• Payment processing via M-Pesa and Pesapal
• AI chat assistants for career guidance and recruitment support

• You must provide accurate, complete, and current information when creating an account.
• You may only maintain one account per person. Duplicate accounts may be suspended.
• You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

The Platform supports three primary user roles, each with distinct capabilities and responsibilities:

• You retain ownership of all content you submit to the Platform, including resumes, job postings, project briefs, and messages.
• By submitting content, you grant SST a non-exclusive, worldwide, royalty-free license to use, process, store, and display your content solely for the purpose of providing and improving our services.
• This license includes the right to generate semantic embeddings of your content for AI-powered matching. Embeddings are anonymized and cannot be reverse-engineered into your original content.
• You are responsible for ensuring that your content is accurate, lawful, and does not infringe on third-party rights.

Our Platform uses artificial intelligence to assist with matching, content generation, and career guidance. By using these features, you acknowledge that:

• AI matching is assistive in nature and does not guarantee employment, project awards, or specific outcomes.
• AI-generated content (such as resume suggestions or job descriptions) should be reviewed by you before submission.
• Match scores and AI recommendations are based on algorithmic analysis and may not reflect all relevant factors.
• We continuously improve our AI models, and matching results may vary over time.

• Payments on the Platform are processed through Pesapal, supporting M-Pesa and other regional payment methods.
• For Dreams2Reality projects, funds are held in escrow and released upon successful completion of each milestone as verified by the project manager.
• Platform fees are deducted from transactions as disclosed at the time of payment.
• Refunds for disputed milestones are handled through our dispute resolution process. Either party may initiate a dispute within 14 days of milestone submission.
• SST is not a party to the employment or service contract between candidates and employers or project managers.

You agree not to:

• Create fake, misleading, or fraudulent profiles or job postings
• Discriminate against candidates or employers based on race, gender, ethnicity, religion, disability, or any protected characteristic
• Harass, threaten, or abuse other users through the Platform's messaging or chat features
• Send unsolicited bulk messages or spam through the Platform
• Attempt to circumvent the Platform to avoid fees or bypass matching
• Scrape, crawl, or use automated tools to extract data from the Platform
• Upload malicious code, viruses, or content designed to disrupt the Platform
• Impersonate another person or entity

• The Platform, including its design, source code, AI models, matching algorithms, taxonomy system, and branding, is the intellectual property of Silicon Savannah Talent.
• You may not reproduce, distribute, modify, or create derivative works based on our Platform without prior written consent.
• Users retain intellectual property rights over their own content as outlined in Section 5.
• The SST name, logo, and brand elements are trademarks of Silicon Savannah Talent and may not be used without authorization.

To the maximum extent permitted by law:

• SST provides the Platform on an "as is" and "as available" basis without warranties of any kind, express or implied.
• We do not guarantee that the Platform will be uninterrupted, error-free, or secure at all times.
• SST shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
• Our total liability for any claim arising from these Terms shall not exceed the fees you have paid to SST in the 12 months preceding the claim.
• We are not responsible for the actions, content, or conduct of other users on the Platform.

• You may terminate your account at any time by using the "Delete My Account" option in your account Settings.
• Upon account deletion, your personal data will be removed in accordance with our Privacy Policy. Anonymized embeddings may be retained.
• SST may suspend or terminate your account if you violate these Terms, with or without notice.
• If your account is terminated for violations, you may not create a new account without our written permission.
• Provisions of these Terms that by their nature should survive termination (including limitation of liability and governing law) will continue to apply.

These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising from or related to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located in Nairobi, Kenya.
